Balancing The Right To Know and The Need For Privacy

The right to privacy and the right to information are both essential human rights. For the most part, these two rights complement each other in holding governments accountable to individuals. But there is a potential conflict between these rights when there is a demand for access to personal information held by government bodies. Georgia law – the Open Records Act – provides a foundation for understanding and managing the right to know and the privacy of individuals. Join us as the First Amendment Foundation leads us in the discussion of the balancing act the governments must do to ensure that the requirements of law and the needs for accountability and privacy are met.

Ken Foskett is Senior Editor for investigations at The Atlanta Journal-Constitution and a board member of the Georgia First Amendment Foundation. Foskett joined the AJC in 1989 as a reporter and covered local government, the state Capitol and U.S. Congress before becoming an investigative reporter for the newspaper. He is the author of “Judging Thomas: The Life and Times of Clarence Thomas” (William Morrow, 2004).

Tom Clyde, a partner at Kilpatrick Townsend, focuses his practice on complex commercial and appellate matters, with an emphasis on representing print, television, internet and communications companies. He has represented clients in an array of litigation in federal and state courts and frequently defends clients in lawsuits challenging First Amendment protected speech.
